Action on Ordinances
Proposal No. 2004-8, granting a nonexclusive franchise to Sanford Avenue Community Club, for location of waterlines on certain county owned rights-of-way; and authorizing the County Executive to execute said franchise.

Proposal No. 2004-10, granting a nonexclusive franchise to Sylvia Lake Water Supply, Inc., for location of waterlines on certain county owned rights-of-way; and authorizing the County Executive to execute said franchise.

Proposal No. 2004-11, granting a nonexclusive franchise to Riviera Community Club for location on water lines on certain county owned rights-of-way; and authorizing the County Executive to execute said franchise.

Proposal No. 2004-21, ratifying the collective bargaining agreement reached with Council 2, Washington State Council of County and City Employees, American Federation of State, County and Municipal Employees (AFSCME), AFL-CIO, Local 3752 – Corrections and Detention Unit; and amending the Pierce County Classification Plan.

Action on Resolutions
Proposal No. R2004-34, declaring its intent to vacate Lybecker Drive Northwest in the west half of Section 4 and the east half of Section 5, Township 21 North, Range 2 East, of the Willamette Meridian, in the Gig Harbor area; and directing the County Engineer to examine the intended vacation and report the findings and conclusions thereof to the council.

Messages from the Executive
1. A message from the Executive transmitting the following Ordinances, which were approved and signed on March 11, 2004:

Ordinance No. 2003-122, vacating a portion of Foss County Road located in the Southwest Quarter of Section 4, Township 20 North, Range 1 West of the Willamette Meridian, in the Key Peninsula area.

Ordinance No. 2003-123, finding the proposed non-exclusive telecommunications franchise to Mashell Telecom, Inc., for a telecommunications network in Pierce County to be in the public interest; setting forth terms and conditions accompanying the granting of the telecommunications franchise; providing for the regulation of construction, operation, maintenance and use of the network; prescribing remedies for the violation of provisions of the franchise; and authorizing the County Executive to enter into the franchise agreement.

Ordinance No. 2003-132, amending Ordinance No. 90-91 (granting a franchise to Elkhorn Water District) by making a technical correction by revising the legal description.

2. A message from the Executive transmitting the following Ordinances, which were approved and signed on March 18, 2004:

Ordinance No. 2003-121s, adding a new Chapter 7.14 entitled “New Technologies” to the Pierce County Stormwater Management and Site Development Manual; repealing Appendix J entitled “Maintenance Including Example Maintenance Schedules” in the Stormwater Management and Site Development Manual; and adopting a new Appendix J reflecting maintenance additions based on New Chapter 7.14.

Ordinance No. 2003-135, amending Section 9.32.020 of the Pierce County Code, by changing the list of devices that may not be possessed, manufactured or disposed of within the county.
